Federal lawsuit argues Hamtramck’s LGBTQ+ Pleasure flag ban is unconstitutional

A federal lawsuit filed Monday alleges the town of Hamtramck’s Pleasure flag ban violates free speech rights and quite a few different state and federal legal guidelines.
The lawsuit within the U.S. District Courtroom in Detroit was filed on behalf of former Hamtramck Human Relations Fee members Russ Gordon and Cathy Stackpoole. The Hamtramck residents have been fired from the fee in July, a month after the all-Muslim metropolis council unanimously authorised a flag “neutrality” ordinance in July.
Though the ban additionally prohibits non secular, ethnic, racial, and political flags, the impetus was the LGBTQ+ Pleasure flag, which many native Muslims complained was an affront to their faith.
The lawsuit, filed by lawyer Marc M. Susselman, argues the ban violates the First Modification proper to free speech and the equal safety clause of the 14th Modification.
“It’s unconstitutional for presidency to pick what speech shall be permitted, and what speech shall be prohibited, based mostly on the content material or viewpoint of the message conveyed by the speech,” the lawsuit states.
Susselman argues that the ban shouldn’t be impartial as a result of it permits the show of the Prisoners of Warfare flag and different international locations’ flags.
The lawsuit seeks to overturn the flag ban and reinstate Gordon and Stackpoole.
In an act of defiance, Gordon and Stackpoole displayed a Pleasure flag on public property on Joseph Campau Avenue on July 9. Police eliminated the flag after a councilman complained.
Two days later, the town council unanimously authorised a decision eradicating Gordon and Stackpoole from the Human Relations Fee.
The lawsuit argues that Gordon and Stackpoole did nothing unsuitable after they displayed the Pleasure flag.
“In so doing, Gordon was not violating the legislation,” the lawsuit states. “An unconstitutional Decision is itself a violation of legislation, and a citizen who violates an unconstitutional, and due to this fact illegal, Decision can’t be violating the legislation. Reasonably, the Councilmen who voted in favor of the unconstitutional Decision violated the legislation by violating the Structure.”
Because the ban, dozens of Pleasure flags on personal property have been vandalized, and residents within the various metropolis say they really feel alienated and maligned by conservative Muslims who view homosexuality as a sin and peddle false narratives about kids being indoctrinated in faculties.
Greater than half of Hamtramck’s residents are believed to be Muslim. In January 2022, Hamtramck grew to become the primary metropolis within the U.S. to have an all-Muslim Metropolis Council. The mayor, Amer Ghalib, can be Muslim.
Tensions between conservative Muslims and progressive started to simmer in the summertime of 2021, when then-Mayor Karen Majewski broke a 3-3 Metropolis Council tie to fly a Pleasure flag exterior of Metropolis Corridor.
A backlash ensued as conservative Muslims started to complain, saying the flag was an affront to their faith. Ghalib, a well being care employee and Muslim immigrant from Yemen, made the flag a marketing campaign problem and handily defeated Majewski, a four-term mayor, in November 2021.
When the council voted to ban Pleasure flags in June, conservative Muslims clashed with LGBTQ+ residents and their allies, with some shouting homophobic slurs. Since then native Muslims have joined forces with conservative Republicans, pledging to create an alliance to oppose LGBTQ+ rights. The coalition is propelled by crackpot concepts that public faculties are “grooming” and indoctrinating impressionable kids.
